By creating an account, accessing, or using PropeloAI ("Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms apply to all users, including agents, brokers, agencies, and any other parties accessing our Service.

2. Description of Service

PropeloAI is an AI-powered content generation platform designed for real estate professionals. Our Service includes:

• Property listing descriptions
• Social media content creation
• SEO-optimized blog articles
• Email marketing templates
• AI image enhancement (Pro plan)
• Team collaboration features (Agency plan)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By registering, you represent that all information you provide is accurate and current.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription and Billing

4.1 Pricing Plans

PropeloAI offers three subscription tiers:

• Starter: $15/month - 30 credits per month
• Professional: $30/month - 100 credits per month
• Business: $50/month - 250 credits per month

4.2 Payment Terms

• Subscriptions are billed monthly in advance
• All payments are processed securely through Stripe
• Prices are in US Dollars (USD) unless otherwise stated
• We may change pricing with 30 days' notice to existing subscribers
• Refunds are provided at our discretion within 14 days of initial purchase

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You'll retain access until the end of your current billing period
• No refunds will be provided for partial months
• Your content will be available for 30 days after cancellation
• You can reactivate your account at any time

4.4 Free Trial

New users may receive a 14-day free trial. You will not be charged until the trial period ends. You may cancel anytime during the trial without charge.

5. Acceptable Use Policy

You agree NOT to use PropeloAI to:

• Generate false, misleading, or fraudulent property information
• Create content that violates fair housing laws or discriminates
• Infringe upon intellectual property rights of others
• Generate spam, malicious, or harmful content
• Violate any applicable laws or regulations
• Attempt to reverse engineer, hack, or disrupt the Service
• Share your account credentials with unauthorized users
• Resell or redistribute our Service without permission

Violation of this policy may result in immediate account suspension or termination.

6. Content Ownership and Usage Rights

6.1 Your Content

You retain all rights to the content you create using PropeloAI. You are free to use, modify, and distribute the generated content for any lawful purpose.

6.2 Our Technology

PropeloAI and all associated technology, software, and AI models remain our exclusive property. You receive a limited, non-exclusive, non-transferable license to use the Service.

6.3 Content Review

While we use AI to generate content, you are solely responsible for:

• Reviewing all generated content for accuracy
• Ensuring compliance with real estate regulations
• Verifying factual information before publication
• Making necessary edits and customizations

7. Intellectual Property

All intellectual property rights in PropeloAI, including but not limited to trademarks, logos, software, and documentation, are owned by or licensed to PropeloAI Limited.

You may not use our trademarks, logos, or branding without prior written permission, except as necessary to identify yourself as a PropeloAI user.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

PropeloAI is provided "AS IS" and "AS AVAILABLE." We do not guarantee:

• Uninterrupted or error-free service
• Complete accuracy of AI-generated content
• Specific results or outcomes from using the Service
• Compatibility with all devices or browsers

8.2 Content Accuracy

AI-generated content may contain errors, inaccuracies, or outdated information. You must review and verify all content before use.

8.3 Limitation of Liability

To the maximum extent permitted by law, PropeloAI shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Data loss or corruption
• Claims arising from inaccurate AI-generated content

Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless PropeloAI, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you generate or publish
• Violation of these Terms
• Infringement of any third-party rights

10. Privacy and Data Protection

Your use of PropeloAI is also governed by our Privacy Policy. We are committed to protecting your personal data in compliance with GDPR and other applicable privacy laws.

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via:

Continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with changes, you may cancel your subscription.
